Our App was built with your privacy in mind. This Privacy Policy (โ€œPolicyโ€) describes how we at untrading.org (โ€œuntrading,โ€ โ€œwe,โ€ โ€œus,โ€ or โ€œourโ€) collect, use, share, and secure your Personal Information when you visit the untrading.org App (https://untrading.org) (the โ€œAppโ€) or create, buy, transfer, trade, transfer, manage, and browse digital artwork and other tokenized assets in our Protocol (the โ€œProtocolโ€) (collectively, including the App, the โ€œServiceโ€).

By accessing the Site or trading untrading.org Items through the Protocol, you agree to this Privacy Policy and our Terms of Service. This Privacy Policy is incorporated into and forms part of our Terms of Service. Capitalized terms not defined in this Privacy Policy have the meanings assigned to them in the Terms of Service.

This Privacy Policy explains what personal information we collect, how we use and share that information, and your choices concerning our information practices.

Before using the Service or submitting any personal information to untrading.org, please review this Privacy Policy carefully and contact us if you have any questions. By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access the App or otherwise use the Service.

01 Personal Identifiable Information Collection

We may collect information reasonably capable of identifying you as an individual (โ€œPersonally Identifiable Informationโ€ or PII). PII does not include anonymous or de-identified aggregated information that does not identify you as an individual.

A. Creating a User Account.

If you sign up to use our App, we collect your

  • Ethereum wallet address through a supported wallet provider, and

  • Your Twitter username and profile picture or avatar, which may contain your likeness.

The User may elect to provide their:

  • Full name

  • Location

  • Email address

  • Phone number

  • Biographical information

  • Social media handles

  • Other websites

B. Visiting and Using the App.

When you visit, use, and interact with the Service, we may automatically log the following information:

  • Device Information: The manufacturer and model, operating system, browser type, IP address, and unique identifiers of the device you use to access the Service. The information we collect may vary based on your device type and settings.

  • Usage Information: Information about how you use our Service, such as the types of content that you view or engage with, the features you use, the actions you take, and the time, frequency, and duration of your activities. We use Google Analytics, a web analytics service provided by Google LLC (โ€œGoogleโ€) to help collect and analyze Usage Information.   • Location Information: We may derive a rough estimate of your location from your IP address when you visit the Site.

  • Email Open/Click Information: We may use pixels or other technology in our email campaigns that allow us to collect your email and IP address as well as the date and time you open an email or click on any links in emails.

C. Internet Activity Information.

We may use the following technologies to collect Internet Activity Information:

  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.

  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

D. Personal Information

We Collect from Publicly Available Sources: We may collect identification information about you from publicly available blockchain networks, such as the Ethereum blockchain.

02 What We Do with Personally Identifiable Information We Collect

We use the PII we collect from users to:

  • Maintain App functionality;

  • Enable you to list, buy, transfer, or trade unique digital art;

  • Provide you with critical updates, confirmations, or security alerts;

  • Provide support or respond to your comments or questions;

  • Personalize and improve your experience and art activity feed;

  • Inform you about products, services, news, surveys, or promotional opportunities we think might interest you;

  • Provide editorial and newsletter content;

  • Analyze and improve our App.

Data collected from Users may be put through algorithms to make decisions about User experiences, create and assign User profiles, and provide other services. No algorithms shall be used to make adverse decisions about Users unless it is to fulfill an affirmative duty to prevent criminal activity.

We also use data collected to meet our Compliance and Protection policies, including to:

  • Comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities;

  • Protect our, your or othersโ€™ rights, privacy, safety or property (including by making and defending legal claims);

  • Audit our compliance with legal and contractual requirements and internal policies; and

  • Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

03 When We May Share Personal Information

We rely on service providers to make some of the Appโ€™s features work, including our website providers or the companies that support the chat, intercom, or customer service features. These providers may have access to the PII we collect so they can do this work on our behalf. We work hard to ensure these providers only access and use your information as necessary to perform their functions. We do not guarantee that other Apps follow best privacy practices.

Our Sharing:

We may share personal information with:

  • Service Providers, including hosting services, email services, advertising and marketing services, payment processors, customer support services, and analytics services.

  • Professional Advisors, such as lawyers and accountants, where doing so is necessary to facilitate the services they render to us.

  • Business Transaction Recipients, such as counterparties and others assisting with a merger, acquisition, financing, reorganization, bankruptcy, receivership, dissolution, asset sale, or similar transaction, and with successors or affiliates as part of or following that transaction.

  • Government Authorities, where required to do so for the Compliance and Protection purposes described above.

  • Affiliates: We may share personal information with our current and future affiliates, meaning an entity that controls, is controlled by, or is under common control with untrading.org. Our affiliates may use the personal information we share in a manner consistent with this Privacy Policy.

  • Complaints: If you are a Creator, we may, at our sole discretion, share your personal information with individuals who claim that your Digital Artwork or Art Content may infringe their intellectual property and other proprietary rights.

Your Sharing:

Your transactions through the Service will be recorded on the blockchain and associated with your wallet ID.

04 Cookies

We also collect basic analytics data through Cookies when you access or use the App. A โ€œCookieโ€ is a small piece of data or text file stored on the local hard disk of your computer or mobile device. These include our own first-party Cookies and third-party Cookies. Some Cookies are only stored temporarily and destroyed each time you close your web browser. Others may remain on your browser and may collect and store data for a period of time after you have left the App.

A. How we use Cookies

  • Functionality: Our App uses Cookies to ensure the App functions properly, including streamlined login, page loads, and our blockchain interface features.

  • Performance and Analytics: Our App uses Cookies to gather usage and performance data. This enables us to monitor and improve the app's performance, our services, and your experience.

  • Google Analytics: We use Google Analytics to understand how users interact with the App and serve you information about products or services we think you may like. You can find out more about Google Analytics and how to opt-out here.

B. How you can control Cookies

If you wish to prevent cookies from tracking your activity on our App or visits across multiple websites, you can set your browser to block certain cookies or notify you when a cookie is set. You may opt out of interest-based advertising in general by visiting the Digital Advertising Allianceโ€™s or Network Advertising Initiative's websites. We are not responsible for the completeness, effectiveness, or accuracy of any third-party opt-out options or programs.

If you block cookies, some features that make the App function property may not work and your experience may be affected.

05 On-Chain Data and Metadata

By using untrading.org you acknowledge that your PII, including your Ethereum wallet address, is stored on the publicly searchable Ethereum blockchain and that neither untrading.org nor any third party, has any power to delete such data published by its Userโ€™s to the Ethereum blockchain. You hereby release and indemnify untrading.org of any data privacy liability associated with data that you published to the Ethereum blockchain by using untrading.org.

1. Your Ethereum Wallet and Transaction History

No entity, including untrading.org, is capable of modifying or deleting data that is stored on the Ethereum and Polygon blockchains. The details of your unNFT-related transactions are public information and stored on the Ethereum and Polygon blockchains in association with your Ethereum and Polygon wallet addresses. Your username is publicly identified with your Ethereum and Polygon wallet address on the Protocol. If your account is ever deleted, then any transaction history on the Protocol will display โ€œanonymousโ€ instead of your username.

2. Artist Works Minted on untrading.org

By using the untrading.org App as an Originator, you may voluntarily embed PII in the Metadata of any minted unNFT(s) or in the media content referenced by the unNFT. All information embedded in the Metadata will not be available for deletion and there is no reasonable expectation of privacy for any PII put in the Metadata or the media content referenced by the unNFT. The Users and Parties associated with the minting, sale, transfer, and use of unNFT(s) are solely responsible for ensuring their PII or other sensitive data are properly protected.

06 Your Rights

A. GDPR

Excluding the limitations discussed in Section 5 and Section 11 of this notice, all users of untrading.org have the right at any time to the following:

  • Opt-Out. Unsubscribe from all marketing communications.

  • Access. Gain access to the PII we have collected and how we use it.

  • Rectify. You may update or correct any inaccuracies in your PII.

  • Erase. You may have your data controlled by us deleted at any time.

  • Export. You may have a machine-readable copy of your PII to you or a third party of your choice.

  • Restrict. You may request to restrict the processing of your PII.

  • Object. You may object to our reliance on our legitimate interests to justify the processing of your PII in a manner that impacts your rights.

You can unsubscribe from commercial or marketing communications from us by following the instructions at the bottom of any email you receive from us.

B. California Privacy Rights

  • Third-party marketing: We do not provide your information to third parties for their direct marketing purposes. However, we may share aggregate or other information that no longer personally identifies you with other parties for our business purposes, marketing, analytics, research, or other uses.

  • Do not track: In the absence of a uniform industry standard for detecting and regulating these signals, we cannot respond to โ€œDo Not Trackโ€ settings from browsers.

07 Security

We employ a number of technical, organizational and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe and we cannot guarantee the security of your personal information and you use the Service at your own risk.

08 Minors and Children

The App is not intended for use by children under the age of 18, and we do not knowingly collect Personal Information from children under the age of 13. If we learn we collected Personal Information from a child under 13 we will delete that information from our files.

09 Third-Party Links and Services

Our Privacy Policy only applies to our App and does not apply to third-party websites or services because we do not control those third parties. We are not responsible for the privacy practices or content of third-party websites. We encourage you to review the privacy policies of those third-party sites to learn about their practices or what rights you may have.

10 Complaints, Disputes, and Actions

If untrading.org receives any notice of a complaint, dispute, or legal action against an artist, collector,, or untrading.org user then we may relay the necessary contact information of that user to the relevant parties. Necessary contact information includes, but is not limited to email addresses, phone numbers, social media handles, real names, usernames, and registered Ethereum addresses. Disputes include, but are not limited to contract, tort, right of publicity, privacy, trademark, copyright, or any other legal, regulatory, or administrative claim. By using the untrading.org App you waive any privacy expectations for your contact information if untrading.org Labs receives any notices of legal, administrative, or other types of complaint, dispute, or action related to your use of the App.

In particular, the Digital Millennium Copyright Act (DMCA) sets forth a Notification and Counter-Notification process initiated by a party complaining of alleged copyright infringement on the untrading.org App. In addition to DMCA, for trademark disputes, or other intellectual property claims untrading.org reserves the right to share information of the notifying, counter-notifying party, and any involved third parties, such as a Collector, of an allegedly infringing artwork to facilitate communication between the relevant parties for the purposes of complying with or resolving a DMCA dispute or allegation of intellectual property infringement. As stated in our Terms of Service, the untrading.org policy is to allow parties to resolve intellectual property, contract, or any other dispute between those parties without any involvement of untrading.org.

11 Important Limitations

Nothing in this Privacy Notice restricts our ability to:

  • Comply with applicable law, rules, or regulations, including the DMCA, trademark or other IP regulations;

  • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or lawful court order;

  • Cooperate with law enforcement agencies about conduct we reasonably and in good faith believe may violate the law;

  • Protect our rights or our property;

  • Enforce our Terms of Service; or,

  • Prevent behavior that is (or that we have reason to believe may be) illegal or unethical.

12 Changes to the Privacy Policy

The Service and our business may change from time to time. As a result we may change this Privacy Policy at any time. When we do we will post an updated version on this page, unless another type of notice is required by applicable law. By continuing to use our Service or providing us with personal information after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and the practices described in it.
